These Terms and Conditions (“Terms”) constitute a legally binding agreement between PGME MEDICAL EDUCATION LLP (“Company”, “PGME”, “we”, “us”, or “our”) and the user (“you”, “your”, “user”), governing your access to and use of our website, mobile applications, learning platforms, digital products, and services (collectively referred to as “Services”).

3. User Account

4. Enrolment, Orders & Availability

  1. All enrolments, subscriptions, and purchases are subject to availability.
  2. PGME reserves the right to modify, suspend, replace, or discontinue any Service at its discretion.
  3. We may cancel any order in case of suspected fraud, misuse, or policy violation.
  4. Incorrect user-provided information shall not be our responsibility.

5. Fees, Payments & Non-Refund Policy

  1. All fees must be paid in full at the time of purchase unless otherwise agreed in writing.
  2. Payments are processed through authorized payment gateways.
  3. You must ensure that payment details are valid and lawfully used.
  4. All payments made to PGME are strictly non-refundable under all circumstances.
  5. No refunds shall be issued for:
    • Change of mind
    • Non-usage of services
    • Partial usage
    • Technical issues from the user’s end
    • Discontinuation of use
    • Any other personal or professional reasons
  6. PGME shall not be responsible for failed or declined transactions due to banking, network, or gateway issues.
  7. Prices and fee structures may be revised without prior notice.

6. Intellectual Property Rights

  1. All content including videos, lectures, notes, documents, branding, software, and designs are the exclusive intellectual property of PGME.
  2. Users are granted a limited, personal, non-transferable license for learning purposes only.
  3. Unauthorized copying, sharing, distribution, or resale is strictly prohibited and may result in legal action.

7. Disclaimer

  1. Services are provided on an “as is” and “as available” basis.
  2. PGME does not guarantee uninterrupted access, error-free content, or specific academic results.
  3. Educational material is intended for learning purposes and does not substitute professional medical, legal, or clinical advice.

8. Limitation of Liability

  1. PGME shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from:
    • Use or inability to use Services
    • Technical disruptions
    • Data loss
    • Payment failures
    • Service interruptions
  2. Liability for declined transactions due to bank limits or security restrictions is expressly excluded.

9. Privacy and Data Protection

  1. User data shall be handled in accordance with our Privacy Policy.
  2. By using the Services, you consent to data collection and processing for operational and educational purposes.
  3. Reasonable security measures are implemented; however, absolute security cannot be guaranteed.

10. Termination and Suspension

  1. PGME reserves the right to suspend or terminate access without notice in case of:
    • Violation of these Terms
    • Misuse of Services
    • Fraudulent activity
    • Unauthorized sharing
  2. Upon termination, all access rights shall immediately cease.

11. Third-Party Services

  1. The platform may integrate third-party services such as payment gateways and video platforms.
  2. PGME is not responsible for third-party service performance, policies, or failures.

12. Amendments

  1. PGME reserves the right to revise these Terms at any time.
  2. Updated Terms shall be published on the platform.
  3. Continued usage implies acceptance of revised Terms.

13. Governing Law and Jurisdiction

  1. These Terms shall be governed by the laws of India.
  2. All disputes shall be subject to the exclusive jurisdiction of courts in India.

14. Force Majeure

PGME shall not be liable for failure or delay caused by events beyond reasonable control including natural disasters, government actions, technical failures, pandemics, or regulatory restrictions.

15. Severability

If any provision is found invalid or unenforceable, the remaining provisions shall remain effective.
